General terms and conditions (for stays under 90 nights)

1. Preamble

Coucou&Co SA is a rental agency specializing in the management of furnished properties owned by third parties. In its activities, Coucou&Co SA acts as the direct representative of the owner of the rented property towards the beneficiary of the rental (hereinafter: the "guest"). For the purpose of these terms and conditions, the term "Coucou&Co" thus refers, for the sake of simplicity, both to the agency itself and to the owner of the rented property.

2. Scope of application

2.1 Conflicting standards rule

The general terms and conditions of third-party online booking platforms (e.g. Booking.com, Airbnb, etc.) take precedence over these general terms and conditions if the booking is made on one of these third-party online booking platforms.

However, if the booking is made directly on the Coucou&Co website (https://booking.coucounco.ch), only these general terms and conditions will be applicable.

Bookings made in establishments operated under the Nonanteneuf appart‧hōtel brand (hereinafter: "Nonanteneuf") are subject to the general terms and conditions published on the Nonanteneuf website (https://nonanteneuf-hotel.ch).

2.2 Depending on length of stay

These general terms and conditions are fully and irrevocably binding on guests making bookings for stays of less than 90 nights or for any booking for which these terms and conditions have been accepted.

3. Formation of the contract

3.1 Contract conclusion

By sending an electronic request or, at the latest, by receiving the written booking confirmation, the guest declares his full acceptance of these general terms and conditions. These terms and conditions can be consulted at any time on the Coucou&Co website (https://booking.coucounco.ch/en/general-booking-conditions).

3.2 Persons concerned

If a third party has acted on behalf of the guest, the guest and the third party shall be jointly and severally liable for all obligations relating to the stay as set forth in these general terms and conditions.

4. Contract start, duration, extension

4.1 Contract start

A booking is confirmed after Coucou&Co has issued the booking confirmation.

4.2 Duration

The accommodation is made available for the period booked. The period indicated in the booking confirmation is decisive. The guest is not entitled to use the accommodation for a longer period.

4.3 Extension

The guest may not shorten or extend a confirmed booking, unless otherwise agreed by Coucou&Co.

5. Booking

5.1 Price

The rental price is clearly indicated in the booking offer.

The rental price includes:

  • Accommodation, furniture, equipment (i.e. household appliances) – as stated in the rental advertisement
  • All utilities (electricity, gas, heating, water etc.) – unless specifically stated otherwise in the rental advertisement
  • Household linen (i.e. bed linen, shower and kitchen towels) and a set of consumables – upon entering the accommodation
  • Wifi / TV – if included in the rental advertisement
  • Exception: Weekly cleaning of the accommodation, including change of household linen and renewal of consumables – for stays of several nights and only if indicated in the rental advertisement and confirmed in the booking confirmation.  

The price of the end-of-stay cleaning, including change of household linen and renewal of consumables, is shown separately.

5.2 Payment

A deposit of 50% of the price of the stay is paid by the guest at the time of booking. The remaining 50% is payable 30 days before the start of the stay. For bookings made less than 30 days before the start of the stay, the full price of the stay must be paid by the guest at the time of booking.

Payments are made by credit card. For bookings made more than 30 days before the start of the stay, payment of the deposit may exceptionally be made by bank transfer, with the express agreement of Coucou&Co.

5.3 Security deposit

Coucou&Co may require a security deposit from the guest as a guarantee for the stay, to be provided before the start of the rental period.

The security deposit is intended to cover any damage caused by the guest or to cover any exceptional costs or damage caused by failure to comply with these general terms and conditions. In particular, damage to the inventory, furniture, accommodation or building, as well as non-payment or other costs (e.g. loss of keys/badges) may be deducted from the security deposit.

The security deposit does not bear interest and will be released within 30 days of the end of the rental period if all amounts due have been paid and no damage has been found at the time of departure.

5.4 Identification documents

At the time of the pre-check-in, which takes place approximately 10 days before the start of the stay, or at any other time requested by Coucou&Co, the guest must provide a copy of his ID as well as those of the other people occupying the accommodation.

5.5 Failure to pay the price, the security deposit or provide identification documents

In the event of non-payment of the deposit, of the balance of the price, of the security deposit, or in case of non-submission of the required identity documents, within the deadlines set before the start of the stay, Coucou&Co reserves the right to cancel the booking and refuse access to the accommodation without delay before the start of the stay, while applying the corresponding cancellation fees (see cancellation policy).

If the guest fails to pay any amount due and owing during his stay, he will be in default on the due date. Coucou&Co will remind the guest to pay the due amount within 3 days. If this deadline is not met, Coucou&Co has the right to immediately cancel the booking; the guest will then lose the right to stay in the accommodation and must leave it immediately (i.e. within 24 hours).

6. Cancellation

6.1 Cancellation policy

When a guest wishes to cancel a booking, the cancellation policy of the third-party online booking platform (e.g. Booking.com, Airbnb, etc.) through which the guest made his reservation applies.

Bookings made in establishments operated under the Nonanteneuf brand are subject to specific cancellation policies posted on the Nonanteneuf website (https://nonanteneuf-hotel.ch).

For bookings made directly with Coucou&Co or via its website (https://booking.coucounco.ch), the cancellation policy is as follows:

  • General cancellation policy:
    • Withdrawal period: Bookings may be canceled free of charge* within 4 hours of booking confirmation, unless otherwise indicated during the booking process.
    • Cancellation: Cancellations made 30 days prior to arrival will receive a 50% refund*. No refunds will be given after this time.
      *In the event of a refund, transaction fees, administrative charges or exchange fees may be levied, depending on the method of payment used at the time of booking.
  • Specific cancellation policy: Specific cancellation policy may apply to a particular property or may be selected by the guest at the time of booking. In such cases, the specific cancellation policy takes precedence over the general cancellation policy and shall apply exclusively to the booking. Applicable cancellation policy will be indicated in the guest's booking confirmation.
  • Notification: To be eligible for a free or partial cancellation, the cancellation request must be received by Coucou&Co before 4 pm within the above-mentioned deadlines, by email at booking@coucounco.ch.

6.2 Cancellation by Coucou&Co

Should the guest fail to show up at the booked accommodation, Coucou&Co reserves the right to cancel the booking, while applying the corresponding cancellation fees (see cancellation policy).

Coucou&Co also reserves the right to cancel the booking, before or during the stay, if the conclusion, continuation or completion of the rental is not or is no longer acceptable. In such cases, the guest must leave the accommodation immediately (i.e. within 24 hours). This is systematically the case in the following situations:

  • The booking was made on the basis of false or misleading information concerning important aspects (e.g. identity of the guest or use of the accommodation not in accordance with its intended purpose).
  • Coucou&Co has objective reasons to believe that the behavior of the guest could cause or significantly affect the proper functioning, safety or tranquility of the building, or the reputation of the other occupants of the building.

7. Arrival and departure

7.1 Inspection

The accommodation is checked by Coucou&Co before each stay. The descriptions given are true and written in good faith.

In the event of damage, missing equipment or any other defect noted upon arrival, the guest must notify Coucou&Co within 24 hours by telephone or by e-mail at booking@coucounco.ch. Unless otherwise denied, the condition of the accommodation is considered satisfactory and accepted without reservation.

7.2 Arrival

Guests are expected to arrive between 4 pm and 8 pm, unless otherwise agreed with Coucou&Co.

7.3 Departure

On the day of departure, the accommodation must be vacated by 11 am at the latest, unless otherwise agreed with Coucou&Co. Late departure without the consent of Coucou&Co may result in additional costs, especially if the delay prevents the cleaning company from accessing the accommodation.

8. Use

8.1 In general

The guest undertakes to treat the accommodation, common areas, inventory, furniture and appliances with the utmost care. Instructions for the use of the accommodation must be scrupulously followed. The guest also undertakes to ensure that the accommodation is used with due consideration for the other occupants and neighbors of the building.

If the obligations of use and care are breached, if the accommodation is occupied by more than the agreed number of people, or if the purpose of the accommodation is not respected, the guest is fully responsible and may have his rental cancelled and must leave the accommodation immediately (i.e. within 24 hours).

8.2 Number of occupants

The accommodation may be occupied by no more than the number of people specified in the booking. Children under the age of 2 are not included in the count.

8.3 Destination

The accommodation may only be used for its intended purpose (private residence). In particular, no commercial activity is tolerated.

8.4 Construction, repair and maintenance

No changes may be made to the accommodation or common areas.

8.5 Animals

Pets (including dogs, cats, birds, reptiles, rats, ferrets, guinea pigs, hamsters, etc.) are prohibited, unless expressly authorized by Coucou&Co.

8.6 Household linen and consumables

Unless otherwise specified, all household linen (complete bed linen, bath and kitchen towels) as well as a set of consumables (toilet paper, dish soap, trash bags, etc.) are provided by Coucou&Co upon the guest's arrival in the accommodation.

8.7 Wi-Fi / TV networks

Wi-Fi / TV access may be included in the rental price, depending on the rental advertisement. Coucou&Co assumes no liability for damages resulting from the use of Internet / TV (spam, viruses, disturbances, connection failures, fraudulent use by the guest, etc.). The guest or third parties may not claim any compensation from Coucou&Co.

8.8 Heating / Air conditioning

Coucou&Co assumes no responsibility for any malfunction of the air conditioning (if present in the accommodation) or heating due to causes beyond its control. The guest is not entitled to any compensation.

8.9 Mail

To receive mail or packages at the accommodation address, the guest is required to follow the instructions provided in the booking guide for the relevant accommodation.

9. House rules

9.1 In general

The house rules applicable are those published on the Coucou&Co website (https://booking.coucounco.ch/en/house-rules), as well as those specified in the booking guide for the relevant accommodation.

9.2 Common areas

The guest must show respect for other building occupants when using common areas, stairwells, elevators and all corridors, and must keep these areas clean. It is forbidden to store objects in these areas, as they may block passage and impede evacuation in the event of an emergency or fire.

9.3 Waste

Waste must be placed in a closed garbage bag and disposed of in the designated container, as indicated in the accommodation's booking guide.

9.4 No smoking

Smoking is strictly prohibited in the building's common areas and inside the accommodation.

9.5 Parties and disturbances

The guest must avoid excessive noise that may disturb other occupants of the building or neighbors and respect their rest between 10 pm and 7 am. It is forbidden to hold parties in the accommodation.

10. Interventions and repairs

Coucou&Co has the right to enter the accommodation at any time in order to carry out any necessary checks or repairs.

If, during the stay, repairs are necessary or urgent to ensure that the guest can use the accommodation as intended, the guest must inform Coucou&Co immediately. Coucou&Co will then arrange for the necessary service providers to intervene as soon as possible.

If repairs are necessary due to damage caused by the guest (blocked drains, damaged appliances, broken glass, etc.), the cost of these repairs will be charged to the guest. Loss of keys/badges will be charged at the actual cost of replacing the necessary equipment. These amounts may be directly deducted from the security deposit.

11. End of stay

11.1 In general

At the end of the rental period, the accommodation must be left in good condition, with furniture in its original position, appliances and crockery clean and tidy, and rubbish bins cans emptied. If the accommodation is found to be in a condition that exceeds the usual degree of soiling resulting from normal use, an amount of up to CHF 55.- per hour of extra cleaning (including administrative costs) may be deducted from the security deposit.

The guest must report any damage caused during his stay. The cost of repairing or replacing any damage or breakage discovered after departure will be deducted from the security deposit.

11.2 Early termination of stay

In the absence of written notice and express authorization from Coucou&Co, the guest's early departure from the accommodation does not entitle the guest to a refund of any part of the rent.

12. Guest liability

12.1 Civil liability

The guest declares that he is covered by a civil liability insurance and will provide Coucou&Co with the insurance certificate upon request.

12.2 Responsibility during the stay

The guest is required to comply with these general terms and conditions. The guest is also solely responsible for any loss, damage or deterioration of the inventory, furniture, accommodation or building, caused by him or by any other person occupying or invited to the accommodation. The guest is also responsible for damage caused by carelessness, smoking and improper use of the accommodation.

In the event of damage resulting from a breach of these terms and conditions, or loss, damage or deterioration of inventory, furniture, accommodation or the building, Coucou&Co is entitled to deduct all or part of the security deposit. If the deposit is insufficient to cover the cost of the damage, the guest will be required to pay the remaining balance of the repair amount, as invoiced by Coucou&Co, within 30 days.

13. Responsibility of Coucou&Co

13.1 Contract performance

Coucou&Co is responsible for the booking and its proper execution, as well as the associated services. Coucou&Co also provides customer service, including through a call center and messaging.

13.2 Exclusion of liability

In general, Coucou&Co declines all responsibility for theft, loss or deterioration of personal belongings of the guest or third parties, as well as for any lack of enjoyment of the accommodation not caused by its fault. Coucou&Co's liability is also excluded for acts and omissions of the guest, unforeseeable or unavoidable acts or omissions of third parties, force majeure or events which any person engaged by Coucou&Co was unable to foresee or avoid despite exercising due care.

14. Impossibility of performance

If events of force majeure or other unforeseeable circumstances beyond the control of Coucou&Co make it impossible to carry out the stay, Coucou&Co reserves the right to cancel the rental and offer the guest alternative accommodation with similar or superior characteristics. If the guest refuses the transfer of the booking or if such a transfer is not possible, Coucou&Co will reimburse all sums received for the booking for the remaining part of the stay, or for the entire stay if it has not started.

15. Data protection

Coucou&Co is authorized to collect, process and use personal data as necessary to ensure the proper functioning of its business. Data will only be stored and passed on to third parties to the extent necessary. The guest agrees to this.

The guest also agrees to the privacy policy published on the Coucou&Co website (https://coucounco.ch/en/privacy-policy/).

16. Applicable law and place of jurisdiction

These general terms and conditions are governed by Swiss law. The exclusive place of jurisdiction is the location of the accommodation.
